Mumbai Smog Surpassing Delhi Becomes an ‘Emergency’: Bombay High Court Slams Authorities Over Air Quality

The deteriorating state of air pollution in Mumbai has become subject to legal intervention, as the Bombay High Court has been extremely concerned about the deteriorating air quality in the city and has questioned the steps taken by civic bodies to address the issue.
The city of Mumbai has been witnessing poor air quality owing to several reasons including dust due to construction activities, pollution due to vehicles, industries, roads, and unfavorable climatic conditions. The condition has been a cause for worry among the people of the city especially children, elderly, and those suffering from respiratory ailments.
Bombay High Court Questions Pollution Control Measures
In this case, the Bombay High Court has emphasized the need for better accountability by the authorities in charge of monitoring and regulating air pollution. It is clear that there are certain apprehensions regarding whether all the required measures are being implemented or not.
Pollution control in Mumbai includes various organizations like the Brihanmumbai Municipal Corporation (BMC), Maharashtra Pollution Control Board and other governmental departments. These agencies have to monitor the air quality, control dust pollution through construction activities, enforce environmental standards, and regulate vehicle as well as industrial emissions.
It is not sufficient to create laws; it is equally important to enforce these regulations consistently throughout the metropolitan city. Inadequate preventive actions at construction sites and the lack of maintenance of roads and presence of heavy traffic can cause a considerable amount of particulate pollution in the atmosphere.
Firecracker pollution even after the creation of regulation prohibiting its use on public roadways was one of the main concerns of the court. For instance, an event took place near Crawford Market where firecrackers were burst out on busy streets close to a police station. Visibility in the city has dropped to less than 500 meters due to the smog situation.
Firecracker Pollution and Construction Dust Under Scrutiny
The court noted that emissions from firecrackers can add to existing pollution, especially during the post-monsoon season, when weather conditions could aid in pollution buildup.
It also expressed its concern regarding the lack of effective action taken on construction sites that produce dust pollution.
The court ordered the Mumbai Police Commissioner to hold a meeting with police station in-charges and make SOPs for implementation of its orders. It also directed the BMC and MPCB to make public notice by October 24 about the health hazards caused by firecrackers and pollution.
It has been demanded by authorities to present compliance report before the next hearing date set for October 26. The court warned that those officials who would not comply with its orders may be made accountable, especially when it comes to public health and fundamental rights of citizens.
Public Health Remains the Priority
Pollution in Mumbai needs coordinated efforts that go beyond seasonal measures. Proper dust control measures in construction sites, air quality monitoring, strict implementation of emission norms, and public awareness regarding these issues are necessary steps to reduce the pollution exposure level.
Similarly, people too need to play their role in this effort by refraining from use of firecrackers in prohibited zones, opting for public transportation where feasible, and reporting any pollution-related violation via proper authorities.
This High Court judgment puts further pressure on the civic agencies and law enforcement authorities to put the existing regulations into practice. The air quality of Mumbai will be determined by proper monitoring and transparency in reporting and accountability. It is important that clean air is protected throughout the year.
