Centre Open to Modifying DPDP Act to Protect Press Freedom, Confirms IT Minister Ashwini Vaishnaw

The Centre is also open to amending the DPDP Act, 2023, to ensure press freedom in light of the rising number of fears raised by news publishers regarding how this new legislation may affect investigative journalism. Union Minister for Electronics & IT Ashwini Vaishnaw stated on October 28 that the government would consider any suggestions made by the publishers and media organizations if any provision raises doubts about the freedom of journalists.
This development has emerged amidst an ongoing legal challenge against the data protection law in view of the fact that no specific exception exists for journalism under this law.
Government Invites Media Organisations for Dialogue
According to Vaishnaw, the DPDP Act does not violate press freedom, stressing that independence of the media is provided for in the Constitution, and inviting editors to talk with the government about their problems.
The minister stated that the law was needed in order to safeguard the personal data of people in the digital form as a result of the Supreme Court recognizing the right to privacy as a fundamental one.
He added that the newspapers and TV channels were involved in consultations prior to the adoption of the law. He stressed that the government did not mean to interfere in investigations or to violate constitutional rights of the press.
Nevertheless, it has been said that some amendments might be considered if it is necessary to make some clear legal guarantees.
Why Are News Publishers Opposing the DPDP Act?
Digital News Publishers Association (DNPA), representing 21 publications, is contesting the Act and its regulations in the Supreme Court.
It has been contended by the association that the law does not have any exemption for journalism. The publishers are especially apprehensive about the rules on consent, processing of personal data, and requests to delete data.
There are many situations when investigative journalism requires the scrutiny of personal details of suspects of any wrongdoings. Asking consent from the suspect would put him on guard about his investigations.
Data deletion requests may create difficulties in maintaining the published reports of the publication.
Supreme Court Seeks Centre’s Response
The Supreme Court of India has been asking for the Centre’s response to the petition filed by the publishers. The next hearing will take place on November 17, 2026.
The case throws up many issues regarding the ability of India to reconcile the individual’s right to privacy and the media’s duty to investigate crimes and make the people aware of it.
Some foreign models of data protection like that of Europe and the United Kingdom have certain provisions that protect journalists, according to the petitioners.
What Could an Amendment Mean for Journalism?
The creation of an express press exemption will help clear up issues concerning the application of data protection laws within newsrooms especially when investigating the actions of public officials and corporations among other newsworthy events.
Such a modification must ensure that any such legislation is not restrictive to the reporting of factual information and does not expose confidential sources.
In the meantime, the Centre has indicated its openness to any modifications, although no official change has yet been put forth. The future course of action for the government will be based on the discussions and ongoing lawsuits.
