Supreme Court Rejects TET Exemption Review Petition: Is Your School Teaching Job Safe? New Rules for In-Service Teachers

According to the Court, this obligation arises out of the need for guaranteeing quality education through the Right to Education framework, and it holds true even for teachers who had been appointed before the implementation of the RTE Act.
What Relief Did Teachers Get?
Even as the court dismissed these petition cases, it invoked Article 142 of the Constitution and granted the necessary extensions to meet compliance.
The time period given to eligible teachers was initially two years from the date of notification for qualifying themselves through the TET exam. However, now, due to the efforts of the Supreme Court, this time period has been extended until August 31, 2028, allowing the candidates another year. No further extensions will be considered for any reason.
This decision has come as a big respite for the teachers, who have said that the previous deadline was insufficient for this large number of employees.
Which Teachers Are Affected?
The order mainly concerns those in-service teachers who were appointed prior to the RTE Act, and have at least five years of service left prior to their retirement. According to the earlier judgment, such teachers would have to compulsorily clear the TET in the prescribed time period.
Those in-service teachers who are near retirement have been given some lenience according to the earlier judgment. In the Supreme Court judgment, it was mentioned that those teachers who had less than five years left until superannuation would be able to continue with their work without TET clearance.

As a teacher-in-service under the order, but haven’t yet taken TET, your employment status is safe for now since the Court has deferred the deadline until August 31, 2028. Nonetheless, it would still be necessary for you to complete the exam within the stated deadline.
Otherwise, non-compliance might prove to have dire consequences especially after the previous ruling which said that teachers who fail to qualify within the specified time shall no longer be allowed to teach in public schools.
What About Promotions?
The decision is not restricted to job retention only. In addition, the Supreme Court has also made it mandatory for teachers to be TET qualified to apply for a promotion. This implies that teachers who fail in TET would not be able to further their career despite being employed under certain exceptions or transitional provisions.
The particular part of the verdict can influence the careers of many teachers for a long time to come.
Why Did States Oppose the Decision?
The states, along with teachers’ organisations, raised objections to the fact that it was unjust to make teachers qualify when they were lawfully appointed based on the terms that existed during the time of appointment.
Tamil Nadu, Kerala, and other states filed review petitions, stating the possibility of teachers losing their jobs after years of service.
Nevertheless, the Supreme Court did not choose to re-examine the fundamental point of the decision.
What Happens Next?
Most states have initiated efforts to conduct special TET tests and training programs to aid the concerned teachers in meeting the requirements of the judgement. Additional TET tests are being conducted by some education ministries and teacher training institutions.
Litigation is no more expected to be the main issue and focus will now move to ensuring the proper implementation of the decision.
