CJP Members Sneak Into Barricaded Jantar Mantar, Hoist Tricolour Before Being Detained by Delhi Police

The members of the Cockroach Janta Party (CJP) arrived at the Jantar Mantar protest venue which is heavily barricaded in New Delhi on Tuesday, October 13, where they unfurled the national flag before being arrested by the Delhi Police. This came after the authorities had declared that Jantar Mantar will no longer be a protest venue, with three other venues for protests being suggested.
The leaders of the CJP, Ashutosh Ranka, Saurav Das and Ajinkya Shinde, were amongst those who got arrested, as per reports from the party. Videos of this act, posted by the CJP founder, Abhijeet Dipke, revealed that the members climbed over a fence and entered the premises with the Tricolour in hand.
CJP Challenges Removal of Jantar Mantar as Protest Site
The party called this act their effort to recover Jantar Mantar as a demonstration place. In his X post, Dipke criticised the police move, saying, “You cannot denotify the resistance.”
The CJP activists stated that they came there to exercise their right to demonstrate in that place and ask the Chief Election Commissioner Gyanesh Kumar to resign. The reason for asking for the resignation lies in the accusations of electoral list revision of SIR process.
Election Commission denied the accusations of its political influence during the electoral list revision process. This question has become one of the main issues in the conflict between the authorities and the demonstrators who want more transparency from the electoral administration.
Delhi Police Names Three Alternative Protest Venues
On Monday, the Delhi police said that Jantar Mantar will not be designated as an area anymore for any form of agitation and sit-in protest. Ram Lila Maidan, Burari Maidan and CBD Maidan in East Delhi have been named as alternative places by the authorities.
This comes at a time when there have been various protests being held along with the call for more protests on account of the electoral roll update row. Increased number of policemen and barricades have been put up in sensitive areas due to the heightened security measures in the national capital.
This move has raised certain concerns regarding the availability of protest locations.
Debate Over the Right to Peaceful Protest
The arrest of CJP members brings back the discussion about the relation between maintaining peace in society and exercising the constitutional right to peaceful assembly as per article 19(1)(b) of the constitution, which ensures that citizens have a right to assemble peacefully and unarmed within the limits of the law.
This is not an unlimited right, and the demonstrations still have to conform to the relevant requirements and restrictions. Nevertheless, the location chosen can affect the way citizens present their demands.
This particular case sheds more light on the growing controversy about the status of Jantar Mantar and the manner in which demonstrations may be held in Delhi. It all depends on how the police will respond to this incident and what actions the CJP will take next.
