Health of Keralam Spas: High-Level Committee Calls for Urgent Comprehensive Law to Safeguard Wellness Industry

Kerala’s wellness and spa business is increasingly coming under the scanner in light of charges of sexual exploitation and illegal operation. Recent efforts at enforcement have brought to light the lack of licensing and supervision within this industry, thereby raising the need for an all-encompassing legal structure to safeguard the welfare of workers, safety of customers, and Kerala’s image as one of India’s prime wellness destinations.
It is reported that there is an ongoing effort by the state government to enact special legislation governing spas and wellness centers, while the police have stepped up raids under a state-wide initiative named Operation Spa.
Regulatory Gaps Raise Serious Concerns
As per reports published on October 24, there are 821 spas registered in Kerala, whereas industry estimates put the number of spas operating in the state at well over 2,000. This discrepancy indicates possible issues with regard to spa regulation, licensing, and monitoring.
In the current scenario, spas operate within general business registration schemes rather than within one common registration scheme that would cover requirements related to therapist qualifications, employee identification, hygiene, and inspections.
This makes it hard for regulators to trace ownership and professional qualification of therapists, as well as compliance with existing legislation, and creates an uncertain business environment for legitimate spas.
Operation Spa Intensifies Statewide Inspections
In response to claims of sexual abuse in wellness centers, the government conducted operation ‘Spa,’ which has reportedly found that there was a gang rape in a spa in Kochi and an exploitation of a minor in another establishment in Kovalam.
The police have found instances of discrepancies in licensing and documentation, and the authorities have filed cases against establishments which have been found guilty of misconducts.
Home Minister of the state, Ramesh Chennithala, has said that the government is thinking of taking action against spas working without a license, but at the same time, he has made it clear that the government will not take any action against legal spas.
What Should a Comprehensive Law Include?
Such an approach could bring about the development of licensing criteria, police checks on staff, accredited qualifications of therapists, as well as regular safety inspections. The adoption of certain criteria to ensure proper functioning will make it easier for authorities to regulate such venues throughout districts.
Furthermore, the regulatory framework should be able to provide protection for the personnel, anonymous reporting system and investigation process for reports about abuse or exploitation. Companies that continue to commit violations can receive appropriate sanctions, up to licence revocation.
Authorities responsible for regulating tourism in the area can contribute by evaluating the level of quality, hygiene and professionalism at these facilities.
However, the regulation of massage parlours should still be pragmatic and straightforward since unnecessary bureaucracy may affect legitimate business without adding to their security. Discussions with representatives of the relevant parties will help to develop appropriate regulations.
Protecting Kerala’s Wellness Tourism Reputation
The Ayurveda and wellness treatments form an integral part of the state’s tourism identity. Any claims of exploitation or illegality could potentially harm not only the reputation of these services but also that of the whole industry, which comprises of many responsible service providers.
Such an act will ensure that there is a clear structure of accountability in place for both providers and consumers to determine which service providers are legitimate.
Of course, the implementation of such a law depends not only on proper drafting but also on efficient monitoring and inspections.
Overall, the protection of the industry cannot rely solely on raids following some serious problems. Kerala needs a regulatory system which will help protect workers and customers and promote ethical providers.
The bill offers a good chance to eliminate the existing problem.
