ITR Filing Penalty After July 31: How to File Belated Income Tax Returns Under Section 234F

Even if you fail to meet the Income Tax Return deadline on July 31, there is no need to panic because you can still make a belated return. The Income Tax Department allows you to file a belated return but will require you to pay a penalty as per the provisions of Section 234F and interest if any tax remains unpaid.
You are still not disqualified from filing your return even when you fail to meet the original filing date. It is best to file the return soon to avoid further hassle.
What is a belated Income Tax Return?
A belated income tax return is an Income Tax Return which is filed after the original deadline provided for it under Section 139(1) of Income-tax Act.
For salaried taxpayers who do not require an audit, the due date for AY 2026–27 filing of Income Tax Return is July 31, 2026. You can still file a belated Income Tax Return before the last date provided on the Income Tax e-filing website as per the conditions applicable. Some reports show that December 31, 2026, is the deadline for filing a belated return for AY 2026–27.
What Is the Penalty Under Section 234F?
In case of submission of your return beyond July 31, a late filing fee as per section 234F could apply.
If the total income is above ₹5 lakh, then there could be a late filing fee of up to ₹5,000. In case the total income is ₹5 lakh or below, then the fee would be ₹1,000.
In addition to the late filing fee, there may be an interest charge under section 234A if any tax payment remains unpaid.
How to File a Belated ITR
The procedure for filing a belated return is almost similar to the procedure for filing a normal ITR return.
Access the Income Tax e-filing website, log in by using your PAN and Aadhar credentials, select the assessment year and the ITR form applicable to you, fill in your income, verify the taxes paid with the help of Form 26AS and AIS, calculate the tax liability and make the necessary payments (if any), and then submit your return.
Verification is the last step before filing your return, which can be done using Aadhaar OTP, Net Banking, bank account EVC, or signing the ITR-V and sending it, in case of non-availability of electronic verification.
What Happens If You Don’t File Even a Belated Return?
Failure to adhere to the deadline might have various ramifications. Apart from the filing delay charges, there will be interest on tax arrears, loss of benefits of certain tax losses, delayed receipt of tax refund, and in some cases, notice from the Income Tax Department. The more time you take, the less chance is left to rectify your tax filing status.
Can You Revise a Belated Return?
Yes, in case you make a mistake while filing your belated return, then the Income Tax Act gives the opportunity to those taxpayers who satisfy the requirements of the Act to file their revised return in accordance with the prescribed period.
This enables them to amend the errors in filing such as income omission, wrong deductions, or wrong data entry.
Will You Still Get Your Tax Refund?
Yes. The submission of the belated ITR will not nullify your claim for the refund amount.
However, there might be a delay in the processing of your refund because belated returns are processed only after the submission and verification. In case you are eligible for a refund, then filing your ITR earlier will be helpful.
Who Should File Belated ITR?
Any taxpayer who has not met the July 31 deadline but has the responsibility of filing Income Tax Return needs to take action immediately.
This applies to all salaried individuals, pensioners, freelance professionals, and others who are eligible to file ITR for AY 2026-27 and have not filed yet.
