CBDT Introduces New Reporting Form 173A for Tax Exemptions on Government Securities

The CBDT has issued Form 173A in order to formalize the reporting requirement for eligible persons seeking tax exemptions on their interest earnings and capital gains on government securities. This form is issued on October 19, 2026, by means of the Income-tax (Seventh Amendment) Rules, 2026, which come under the Income-tax Rules, 2026.
This amendment seeks to formalize the process of tax exemptions available under the Income-tax Act, 2025. It does not confer any universal tax exemption upon all those who invest in government securities.
What Is Form 173A?
Form 173A is a form to be filled by those who qualify for the exemption as per entries 13D and 13E of Schedule IV to the Income Tax Act, 2025. The new rules state Rule 281A that makes providing of such information compulsory for availing of such exemptions.
Such provisions apply to those foreign institutions and BIS that satisfy certain conditions under the law.
Such exemptions include those relating to interest income and capital gains earned from the sale, exchange, or transfer of government securities. Individual investors holding government bonds will not be eligible for such exemptions on their own.
What Information Must Investors Provide?
Form 173A has two sections. Section A contains the information regarding identity and contacts of the claimant, which include name, country of residence, address, Permanent Account Number (PAN), tax year, email address and contact number. It also demands the tax identification number of the country of residence along with SEBI registration details.
This section requires investment-specific information. This means that the information which needs to be disclosed includes the International Securities Identification Number (ISIN), information on each security held by the claimant, holding positions at the start and end of the period, acquisition during the tax year, sales proceeds, interest, or accrued capital gain.
Investments may include Treasury bills, fixed-rate bonds, floating rate bonds, and State Development Loans (SDLs). The claimants are expected to confirm that the information provided by them is true and conforms to the relevant legislation.
When Do the Changes Come into Force?
The amendments entered into force on October 19, 2026 following its publication in the Official Gazette. It is an established procedure for filing a claim in the framework of the relevant exemption rules.
It is advisable that eligible investors keep a record of their investments in government securities, the related transactions, and any interest and capital gains to support their claim.
What Does This Mean for Investors?
The intention behind using Form 173A is to make the process of making tax exemption claims more structured and increase the availability of information for the tax department. As a result of this structure and the necessary details, it may become easier to maintain records on claims made through these specific provisions.
For the qualified foreign investors and institutions, it will be crucial to comprehend the changes in the requirements to claim the appropriate tax concessions. The main thing to remember about Form 173A for the retail investor is that it is a specific compliance requirement and not an additional tax-free benefit.
