‘Falsus in Uno, Falsus in Omnibus’ states the HC of Karnataka over the unnatural sexual case of Malayalam Director Ranjith
The outbreak of Hema Committee in which stratified sexual allegations against the pivotal Malayalam Film Industry figures which included both actors and other technical members like Siddique, Riyas Khan, Ranjith, Jayasurya,Mukesh and Edavela Babu. Some of them were arrested and few went on hiding after the allegations. Many of the other artists and technicians from the other film industries welcomed their initiatives. The alleged actors and other technicians have been appearing at the court after the indictments.
The Route of Director Ranjith’s Allegations
On August 31, 2024 an unnatural sexual assault case has been filed against the well-known director Ranjith Balakrishnan. The FIR of this case stated that a 31-year old (aspiring) actor had been sexually assaulted in an unnatural way by the director Ranjith at Taj Hotel in 2012. Under IPC section 377 and Section 66E of the Information Technology Act, 2000 the case had been filed and the case was investigated by the KIA Police Station.
The alleged director appeared at the hearings and said that these allegations by the victim contain many inaccuracies, in particularly the location about which she has mentioned in her complaint. It is completely contrasting with the year and location on which the incident was told by the complainant.
On December 11, 2024, the hearing took place at the High Court of Karnataka and after reviewing all the submitted records of both the sides the Justice M.Nagaprasanna stated that the complaint seems to be false in the Prime Facie itself.
“I don’t even say prime facie, as the said hotel near the airport started operations only in 2016, and the same is in the public domain, four years after the incident. Therefore, the vivid narration at the Taj Hotel is absolutely false. This is thus a canard”.
Justice M.Nagaprasanna also raised questions about the delay in giving the complaint against the director Ranjith as ‘why it took 12 years to come forward’. He described this case as ‘Falsus in Uno, Falsus in Omnibus’, a latin legal maxim which means “False in one thing, false in everything”. He also ordered an interim order of stay of all the proceedings and investigations against the director. On the next hearing which is scheduled on January 17, 2025 a notice will be issued and sent to the KIA police station, and the complainant, Justice added.
