US Supreme Court Abolishes The Constitutional Right To Abortion

The Supreme Court of the United States abolished the women’ constitutional rights to abortion. People have been protesting against this for the last one month.

The US Supreme Court on Friday overturned an important 50-year-old decision, ending women’s constitutional right to an abortion.

In such a situation, now American women will not be able to have an abortion of their own free will.

This decision of the Supreme Court is considered a big setback for the Democratic Party, because it has been a supporter of this right. In such a situation, now the protest against the decision can intensify.

The US Supreme Court Overruled

In the case, the Supreme Court said that the Constitution of the country does not provide for the right to abortion. In such a situation, his decision given in the year 1973 in his ‘Roe v Wade’ case is quashed.

Let us tell you that the Supreme Court had ensured the right of a woman to abortion in that case.

The court had said that different states of America can implement this process with their own permission.

No Abortion After 15 Weeks Of Pregnancy

A nine-member bench of the Supreme Court, with a 6-3 majority, upheld the Republican-backed Mississippi law, eliminating the constitutional right to abortion.

Under this law, no woman can have an abortion after 15 weeks of pregnancy.

Let us tell you that in the year 1992 also, the Supreme Court, while upholding its old decision in one such case, had told a mother completely free to get an abortion.

2 Separate Groups for Abortion Rights

Let us tell you that the issue of abortion in America has always been sensitive. People are divided into two factions regarding this. 

Conservative groups and Christian churches, including the Republican Party, have been campaigning against giving women the right to abortion.

In contrast, the Democratic Party and other factions have been supportive of abortion. There is no law in the US that justifies abortion. This was upheld in a judgment of the Supreme Court in 1973.

Ongoing Protests Since One Month

A Supreme Court document linked to this was released earlier last month, which led to nationwide protests.

According to the draft, abortion rights are set to be scrapped and the Supreme Court has voted to overturn the 1973 Roe v. Wade decision.

After that demonstrations started in America. A large population of America considers abortion to be a fundamental right and is against the decision.

Government’s Plan of Action

After this decision of the Supreme Court, now the Democratic government can make a law to implement this right.

This is because President Joe Biden said last month that women have a fundamental right to decide whether or not to have an abortion. 

If the Supreme Court reverses the decision, then Congress must enact a law to protect the right to abortion. Many MPs also supported him.

Probability To Pass The Law

According to experts, it is not easy for President Biden and other Democratic leaders to enact legislation to secure abortion rights.

For this, the support of 60 members will be required under the filibuster rule in the 100-member Senate.

The Democratic Party currently has only 51 votes, including 50 senators and a vice-president. Although the President can legislate by repealing the filibuster rule, it is very difficult.

Abortion Statistics In The US

According to a report by the Guttmacher Institute, a research group advocating abortion rights, there were more than 9,30,000 abortions in the US in the year 2020, compared to around 8,62,000 in 2017.
