Union Minister Gets Bail In Defamation Allegation Against Maharashtra CM

The court has awarded clemency to BJP Rajya Sabha member and Union Minister, Narayan Rane in a case of a possible act of defamation against the current serving Chief Minister of Maharashtra, Uddhav Thackery.

In a formal statement the court said, that “while his arrest is justified, there is no need to keep him in custody.” Mr. Rane had threatened to publicly slap the CM.

 Having produced in front of the Judicial Magistrate First Class (FMFC), it was decided that the cabinet minister does not need to be necessarily sent to police custody. Mr. Rane’s lawyers had already argued against the irrelevance of this and that he had maintained good conduct with the police authorities. 

Crime, as committed by Mr. Rane, is liable to three years of imprisonment. While in progress the JMFC court also pulled up the police authorities for not maintaining the requisite case diary as per the procedure.

However, persecution made a point that the accused might repeat this behavior in public. Mr. Rane’s lawyers said that while they had advised Rane not to make such statements in public at large, he had not conceded to give an undertaking quoting his liberty.

The court considered the charges against him and noting that most of them were bailable and two other sections-153 (A) (1) (b) (promoting enmity between different groups) and 505 (2) (statements conducing to public mischief) of the Indian Penal Code had punishment not more than three years, granted him bail.

Mr. Rane’s comment came after the CM apparently forgot the number of years to India’s independence in a public speech. Mr. Rane has recently been appointed as the Union Minister of Micro, Small, and Medium Enterprises. His remarks obviously triggered a wave of anger among Sena activists, who pelted stones on BJP offices in Nashik, Pune and Mumbai and clashed with BJP cadre in Mumbai and elsewhere.
