Uttar Pradesh’s Yogi Adityanath has proposed a striking law to control the surging population in the state. The draft bill that has been proposed of the Population Control Act has provisions that will give special government schemes benefits to parents with only one child in the state.
However, the parents seen deterring from the 2-child norm will be debarred from these schemes and will also face the limitation of ration card units to four. The bill also proposed that these couples be banned from contesting in local body elections and applying for government jobs.
The couples who will follow the two children norm would be eligible for benefits like two additional increments during the entire period of service, a subsidized purchase rate of a house or plot, and 3% increase in EPF under National Pension Scheme. Furthermore, parents with only 1 child will enjoy benefits above all of these.
The draft bill has been uploaded on the Commission’s website with the objective of seeking public opinion, confirmed State Law Commission Chairman Justice A.N. Mittal. The last date of relaying suggestions is July 19, 2021. The draft bill also includes provisions in polygamy and polyandry.
The draft bill says, “(a) The personal law governing A allows polygamy. A has three wives B, C and D. A and B, A and C and A and D shall be counted as three distinct married couples so far as the status of B, C and D is concerned but as far as the status of A is concerned, it shall be counted as one married couple for the purpose of calculation of a cumulative number of children”.
“For example. A has one child from B, two children from C and one child from D, the total number of children of A shall be four. (b) The personal law governing B allows polyandry. B has two husbands A and C. B and A shall be counted as one married couple. B and C shall be counted as another married couple…”
Incentives for people with a single child include two additional increments; free health care facility and insurance coverage to the child till he/ she reaches the age of 20 years; preference to the single child in admission in all educational institutes including but not limited to IIM, AIIMS; free education up to graduation level; scholarship for higher studies for girl child; preference to the single child in government jobs, and many more.
