Lawyers write to CJI on calls of genocide in Haridwar, Delhi hate speeches; call for suo motu cognizance

Delhi – A group of 76 top lawyers of Supreme Court have asked the Indian apex court to take suo motu cognizance of “ethnic cleansing” calls made recently at two religious events in Haridwar and Delhi. The lawyers made this request in a letter to Chief Justice of India N. V. Ramana. The letter included names of lawyers who have made this call to the chief justice, adding that lack of police action will aggravate the sensitive situation. “Urgent judicial intervention is required to prevent such events that seem to have become the order of the day.” The lawyers in the letter said, “The aforementioned events and the speeches delivered during the same are not mere hate speeches but amount to an open call for murder of an entire community.”

The letter said, “The speeches, thus, pose a grave threat not just to the unity and integrity of our country but also endanger the lives of millions of Muslim citizens.” The letter has been signed by eminent lawyers like Dushyant Dave, Prashant Bhushan and Vrinda Grover, Salman Khurshid and former Patna High Court judge Anjana Prakash.

Ramana to take suo motu cognizance the letter added, “In view of the seriousness and gravity of the aforementioned events it is most humbly prayed that Your Lordship may take suo-moto cognizance of the same and direct that action be taken against the guilty persons under Sections 120B, 121A,153A, 153B, 295A and 298 of the Indian Penal Code, 1860.”

After the event in Haridwar where open call was made for genocide and use of weapons against Muslims, social outrage and criticism led to filing of police case, though after four days. Earlier only one name was included in the report, and later two names were added of Dharm Das and Sadhvi Annapurna. One video circulating on social media shows Sadhvi Annapurna, formerly known as Pooja Shakun Pandey, saying, “If you want to finish them off, then kill them… We need 100 soldiers who can kill 20 lakh of them to win this.”

Hindu Raksha Sena’s Prabodhanand Giri is heard saying in a video making rounds on social medial, “Like Myanmar, our police, our politicians, our Army and every Hindu must pick up weapons and conduct a Safayi Abhiyan (ethnic cleansing). There is no other option left.” He has often been seen with BJP leaders including UP Chief Minister Yogi Adityanath.

“We are writing to your Lordship hoping for prompt action in your capacity as the head of the judicial wing of the State and knowing your Lordship’s commitment to both the independence of Judiciary as also the constitutional values that are fundamental to the functioning of a multicultural nation such as ours,” the top lawyers have urged the CJI in the letter.
