Is Rahul Gandhi Acquitted of Defamation Charges by SC?

Rahul Gandhi, the leader of the Congress, was greatly relieved when the Supreme Court on Friday decided to stay his conviction in the “Modi surname” case.

Rahul was given a maximum sentence of two years, but the top court ruled that this was not justified and that Rahul was therefore disqualified from running for office.
The trial court’s order has broad repercussions. Rahul Gandhi’s right to remain in public life was also compromised, according to the supreme court, as was the right of the people who elected him.

The Gujarat High Court’s decision to not grant Rahul Gandhi’s request for a stay of execution in the criminal defamation case stemming from his remark about the “Modi surname” was being appealed by the Congress leader.

However, the Supreme Court noted that Rahul’s remark was not in good taste and that those in positions of public trust should exercise restraint and caution.

There is no denying that some statements are offensive, and those who live in public are expected to use caution when giving speeches. The top court added that Rahul Gandhi should have been more cautious.

The Supreme Court’s decision to uphold Rahul’s conviction was applauded by Congress, which stated that “no force can silence the voice of the people.” It was deemed a “victory of love over hate” by the gathering.

Randeep Surjewala, the general secretary of the Congress, praised the decision and declared that justice had won out. He declared, “The halls of democracy will once more resound to the roar of truth.”

A senior attorney representing Rahul testified before the Supreme Court that despite numerous cases brought against him by BJP members, the Congressman is not a seasoned criminal and has never been convicted.
Democracy is characterized by dissent and disagreement. what we refer to as “shaleen bhasha.” There is no hardened criminal in Rahul Gandhi. BJP members have brought numerous cases, but no one has ever been found guilty. According to Singhvi, Rahul has already missed two sessions of the Parliament.

Additionally, he informed the Supreme Court that the former Gujarat minister Purnesh Modi, who brought the defamation lawsuit against the former Congress president, did not originally go by the surname Modi. Modi is not Purnesh Modi’s original last name. The senior attorney addressed the three-judge panel of Justices BR Gavai, P S Narasimha, and Sanjay Kumar, saying, He belongs to Modh Vanika Samaj.

Why do all thieves have the same last name, Modi?
Rahul Gandhi said this at an election rally in Kolar, Karnataka, on April 13, 2019. In 2019, Purnesh Modi sued Gandhi for criminal defamation.
