Dr BR Ambedkar, the principal drafter of the Indian Constitution, had refused to draft Article 370. He was the first law minister of India. Ambedkar became a key figure in India’s constitution-making process.
In 1949, former Prime Minister Jawaharlal Nehru directed Kashmiri leader Sheikh Abdullah to consult Dr BR Ambedkar to prepare the special article. Nehru wanted to include the special article in the Indian Constitution.
Article 370 was eventually drafted by Gopalaswami Ayyangar. He was a minister without a portfolio in the first Union Cabinet of India. He also worked as a Diwan to the King of the state of Jammu and Kashmir, Maharaja Hari Singh.
Article 370 is drafted in the Amendment of the Constitution section, in Part XXI, under Temporary and Transitional Provisions. Under Article 370 the Indian Parliament cannot increase or reduce the borders of the state.
Article 370 allowed the Jammu and Kashmir state a certain amount of autonomy, including its own constitution, a separate flag and freedom to make laws. It was not a criminal offence to insult India’s national symbols in Jammu & Kashmir.
In 2019, the government of India revoked Article 370, which provided special provisions exclusively to the Jammu and Kashmir state of India. Union Home Minister Amit Shah announced this news in August 2019.
Earlier, Assembly elections were held in Jammu & Kashmir once every six years. After the revocation of Article 370, Assembly elections will be held once in five years like in other states of India.
