Battle of laws on Registration of Marriages Bill in Rajasthan

Rajasthan – A Bill was passed a few months ago, which sought to amend the 2009 Act to make registration of all marriages within 30 days mandatory. Through the bill, which was also passed by the state Assembly, ruling party of the state, Congress legalized child marriage in the state.

However, the ruling Congress maintains that the Bill is not meant for the validation of child marriages but is to ensure that all marriages in the state, including child marriages, are registered as required by the Supreme Court.

Seeing the turn of events hundreds of BJP youth wing activists staged protests and submitted a memorandum demanding the repeal of the Registration of Marriages Bill, 2021 on the grounds that it makes registration of child marriages mandatory in the state.

Even the NCPCR raised concerns that the bill legitimizes child marriage in the state and pushes future of innocent kids in the dark past of marriage tradition. Chief Minister Ashok Gehlot said the government is working with a strong will for the complete eradication of child marriage in the state. They are of the opinion that child marriage should not take place in the state and the government will not make any compromise in this regard.

He said the bill was brought after a Supreme Court directive, which says all marriages, should be registered. However, the Rajasthan government requests the governor to return the bill due to the incorrect notion over child marriages. CM Gehlot further added that are in consultation with a team of lawyers whether to take the bill forward or not, while addressing a program on International Girl Child Day. In the shocking report that was released in 2015-16, it stated that 35 per cent of the marriages in the state involved minors.
