Amit Shah May Introduce Centre’s Bill to Replace Delhi Ordinance

Sources say Lok Sabha will introduce a bill Monday allowing the center to control Delhi bureaucrat postings. Sources said Union Home Minister Amit Shah would introduce the legislation to replace the ordinance that has caused a significant standoff between the Arvind Kejriwal government and the center.

The legislation should pass Lok Sabha easily, but Rajya Sabha, where it lacks a majority, will be harder.

The cabinet approved the Parliamentary Bill yesterday.

Most Opposition parties, united under INDIA, support the Aam Aadmi Party (AAP) government on the Delhi ordinance issue.

Government can bring an ordinance when Parliament is not in session, but the legislature must approve it within six months of a session.

In May, the Supreme Court ruled that the Delhi government would control all services in the national capital except public order, land, and police.

The center wants a retrial. After the big court ruling, the Arvind Kejriwal government challenged the center’s ordinance in the Supreme Court.

Last week, the Supreme Court ordered a five-judge constitution bench to determine whether Parliament can “abrogate the constitutional principles of governance” for the Delhi government by taking away its control over services.

The order by Chief Justice DY Chandrachud, justices PS Narasimha and Manoj Misra asked (i) what are the contours of Parliament’s power to enact a law under Article 239-AA(7), and (ii) whether Parliament can abrogate the constitutional principles of governance for the National Capital Territory of Delhi (NCTD).
